New York State DMV Driver Responsibility Assessment Program

What is the New York Driver Assessment Program?

Under the NY Driver Assessment Program, a motorist must pay the DMV each year for three (3) years if the motorist:

(a) incurs six (6) or more points on their driving record for violations occurring on or after November 18, 2004;

(b) is convicted of an alcohol- or drug-related traffic infraction and the violation occurred on or after November 18, 2004; or

(c) refused to take a chemical test on or after November 18, 2004.

How will I be notified if I must pay the driver responsibility program tax?

The DMV will send the motorist a statement after the above mentioned points, conviction or refusal are entered on the motorist’s driving record. The DMV will examine the motorist’s driving record every three (3) months to determine if a new driver responsibility assessment is necessary. If there are no new incidents reported on the motorist’s driving abstract, the DMV will send annual bills.

Can I reduce the amount of the driver responsibility assessment by taking a driving safety class that offers points reduction?

NO. While taking a driving safety class can take up to four (4) points off of your license, this only helps soften the impact of insurance premiums and reducing points on a motorist’s license if it is subject to suspension for carrying too many points.

What will happen if I fail to pay the driver responsibility assessment?

The motorist’s privilege to operate a motor vehicle in New York State will be suspended until it is paid.
