Nassau and Suffolk Counties Speeding Ticket Attorney

Penalties for Speeding in New York

The penalties for speeding depend on the number offenses and how must faster than the speed limit you were going. The penalty for a first conviction can generally range from $45 to $600. If you were going less than 10 miles over the posted speed limit, for example, the ticket may cost you between $45 and $150. Speeding between 11 and 30 miles an hour can result in a fine between $90 and $300. Going more than 31 miles over the posted limit can lead to fines ranging from $180 to $600.

In New York, a moving violation surcharge of $70 will also be assessed against you. It is worth noting that the fines are increased for second and third convictions, which can ultimately result in a license suspension or revocation. Although it is rare, a judge can even give you a jail sentence of up to 30 days for a speeding ticket violation.

Driver License Points

In addition to fines, the DMV implements a points system for moving violations — failing to use a turn signal, disobeying traffic signals, driving under the influence (DUI), and speeding. The number of points that will be assessed against your license for a speeding infraction depends on how fast you were going:

  • Between 1 and 10 miles over the speed limit — three points
  • Between eleven and twenty miles over the limit — four points
  • Between twenty-one and thirty miles over the limit –six points
  • Between thirty-one and forty miles over the limit — eight points
  • Forty-one miles or more over the limit — eleven points (and an automatic license suspension)

New York also imposes a Driver Assessment fee for those who have accumulated at least 6 points on their licenses. Because these violations  become part of your driving record, it is likely that you will also face higher insurance premiums.

What should I do if I am pulled over for speeding?

If you are stopped by the police or state highway patrol officers, you should cooperate. Be prepared to produce your license, registration and driver’s insurance card. Did you know that you will be charged will additional violations if you are not carrying these items? Above all, do not get into an argument with the police over how fast you were going. At the same time, do not admit your guilt.
