How Many Traffic Tickets Does It Take to Lose Your License in New York?

Receiving a traffic ticket can be frustrating, but many drivers make the mistake of thinking that one ticket is «no big deal.»

In New York, it is not necessarily the number of tickets you receive that puts your driver’s license at risk. Instead, the New York State Department of Motor Vehicles (DMV) uses a point system to determine when a driver may face penalties, including license suspension.

Understanding how the point system works can help you make informed decisions if you are issued a traffic ticket.

How Does the New York Point System Work?

Certain traffic violations carry points that are added to your driving record if you are convicted or plead guilty.

The more serious the violation, the more points it carries. For example:

  • Speeding 1 to 10 mph over the limit: 3 points
  • Speeding 11 to 20 mph over the limit: 4 points
  • Speeding 21 to 30 mph over the limit: 6 points
  • Speeding 31 to 40 mph over the limit: 8 points
  • Speeding more than 40 mph over the limit: 11 points
  • Using a handheld cell phone while driving: 5 points
  • Reckless driving: 5 points
  • Following too closely: 4 points
  • Failure to yield the right of way: 3 points

Not every traffic violation carries points, but many of the most common moving violations do.

Mark is a kind and honest attorney. He really worked hard on my case and helped me to get the maximum relief possible. His support staff are great too- very professional and responsive.

So, How Many Tickets Can Cause You to Lose Your License?

There is no simple answer.

A driver who receives several minor violations over time may accumulate enough points to face consequences. Likewise, a single serious speeding conviction can add a significant number of points to your record.

In New York, accumulating 11 or more points within an 18 month period may result in a suspension or revocation of your driving privileges.

That means it is possible for just a few traffic tickets to place your license at risk, depending on the violations involved.

Your License Is Not the Only Thing at Stake

Many drivers focus only on avoiding a suspension, but traffic tickets can have other long term consequences.

A conviction may lead to:

  • Increased auto insurance premiums
  • Additional DMV fees and assessments
  • Points on your driving record
  • Employment concerns for commercial drivers or individuals who drive for work
  • Greater risk of license suspension if you receive future tickets

Even a ticket that seems relatively minor today can become much more significant if you receive another violation later.

Should You Just Plead Guilty?

Many people receive a ticket, pay the fine, and move on with their lives.

However, pleading guilty is also a conviction. Depending on the violation, it may result in points being added to your driving record.

Before deciding how to respond to a traffic ticket, it is important to understand the potential consequences. In some situations, there may be options available to reduce the impact of a citation.

Every case is different, and the best course of action depends on the specific facts and your driving history.

Can an Attorney Help?

Many drivers are surprised to learn that an attorney may be able to appear in court on their behalf in certain traffic matters, potentially saving them time and reducing the need to appear personally.

An experienced traffic ticket attorney can review the facts of your case, explain the potential consequences of a conviction, and discuss your available options.

Seeking legal guidance early may help you avoid unnecessary points on your driving record and protect your driving privileges.

Do Not Wait Until Your License Is in Jeopardy

One ticket may not seem like a big deal. However, multiple violations or a serious offense can quickly add up.

Understanding New York’s point system and addressing traffic tickets promptly can help you avoid costly mistakes that may affect your license, insurance rates, and driving record.

If you have received a traffic ticket in New York, the experienced attorneys at MontanaroLaw can evaluate your situation, explain your options, and help you work toward the best possible outcome.
